Each project or campaign may have a separate written agreement specifying deliverables, timelines, and fees.
4. Payment Terms

All fees must be paid according to the terms outlined in your proposal or invoice.

Payment for marketing services is typically due in advance of work commencing.

Late payments may incur interest or service suspension.

All third-party advertising costs (e.g., Google, Meta, TikTok) are non-refundable and billed separately from GMart Group Inc service fees.
5. Refund Policy
Refunds are governed by our official Refund Policy, available on our website.
In general, payments are non-refundable once services have started, except in cases of duplicate payment or documented billing error.
6. Client Responsibilities
Clients agree to:

Provide accurate and timely information needed for campaigns.

Approve creative assets, budgets, and timelines promptly.

Maintain valid payment methods for recurring services.

Comply with advertising platform policies and applicable laws.
We are not responsible for delays or performance issues caused by missing or inaccurate client information.
7. Performance Disclaimer
While GMart Group Inc uses proven marketing strategies and tools, we cannot guarantee specific results, such as revenue increase, search ranking, or traffic growth.
Performance depends on multiple factors outside our control, including market conditions, competition, and platform algorithms.
8. Intellectual Property
All materials created by GMart Group Inc (ads, graphics, strategies, reports, etc.) remain the property of GMart Group Inc until full payment is received.
Upon payment, ownership of finalized deliverables transfers to the client unless otherwise agreed in writing.
We may showcase completed projects in our portfolio or for marketing purposes unless confidentiality has been requested in writing.
9. Confidentiality
Both parties agree to keep all confidential information (business plans, strategies, client data, etc.) private and not disclose it to third parties without written consent.
10. Limitation of Liability
To the fullest extent permitted by law, GMart Group Inc shall not be liable for:

Any indirect, incidental, or consequential damages

Lost profits, data, or opportunities resulting from use of our services

Technical issues or downtime caused by third-party platforms
Our total liability for any claim shall not exceed the total fees paid by the client within the previous three (3) months of the incident.
11. Termination
Either party may terminate services with written notice as defined in the service agreement.
Upon termination, the client remains responsible for all work completed and ad spend incurred up to that date.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the courts of Los Angeles County, California.
13. Updates to Terms
We may update or revise these Terms at any time. The updated version will be posted on our website with a new effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.
